Notice is hereby given that Delta City Council will consider giving first, second, and third readings to the bylaws referenced below at its Regular Meeting at 4:00 p.m. on Monday, April 8, 2024 in the Theatre, North Delta Centre for the Arts, 11425 84 Avenue, Delta, BC.

Location: 11599 81A Avenue

Applicant: Joe Muego, Hearth Architectural Inc.

Proposal: To rezone the subject property from Single Detached Residential 4 (RS4) to Single Detached Residential 7 (RS7) to allow subdivision from one to two lots and construction of a new single detached dwelling with a secondary suite on each lot. This application is consistent with Delta’s Official Community Plan.

Bylaw Nos. 8379, 8380, 8381 & 8387 (File No. P24-02)

Location: City-wide (broad application)

Applicant: City of Delta

Proposal: To streamline secondary suite applications and remove barriers for owners leasing or renting a secondary suite through the fo llowing bylaw amendments:

i. “Delta Zoning Bylaw No. 7600, 2017 Amendment (Secondary Suites – P24-02) Bylaw No. 8379, 2024” would amend:

a. the definition of Secondary Suite Occupancy Permit in order to authorize the General Manager, Development to issue a secondary suite occupancy permit; and

b. the general regulations for secondary suites in order to authorize the General Manager, Development to revoke an occupancy permit for secondary suites that are not suitable to occupy due to health and safety issues and to approve the decommissioning of a secondary suite.

ii. “Delta Business Licence Bylaw No. 7670, 2017 Amendment (Secondary Suites and Rental Permit – P24-02) Bylaw No. 8380, 2024” would:

a. remove Rental Permit from the definition of Licence;

b. remove the definitions for Rental Permit and Secondary Suite;

c. amend the general regulations for licence requirements to remove the requirement for a person to hold a valid rental permit i n order to lease or rent a secondary suite;

d. remove Secondary Suites from Part 6: Specific Provisions; and

e. remove the $50 licence fee for a secondary suite from Schedule “A” - Business Licence Fees.

iii. “Municipal Ticketing Information Bylaw No. 6639, 2007 Amendment (Rental Permit – P24-02) Bylaw No. 8381, 2024” would remove the penalty for an owner leasing or renting a secondary suite without a valid Rental Permit from the list of penalties in Schedule 1.

iv. “Delta Bylaw Notice Enforcement Bylaw No. 7009, 2011 Amendment (Rental Permit – P24-02) Bylaw No. 8387, 2024” would remove reference to the penalty for an owner leasing or renting a secondary suite without a valid Rental Permit from the list of penalties in Schedule A.
