Notice of Alternative Approval Process

PUBLIC NOTICE IS HEREBY GIVEN that pursuant to section 86 of the Community Charter, Council is seeking approval of the electors of the City of Delta by Alternative Approval Process.

The Proposal

The City of Delta is proposing to exchange land with the Board of Education of School District No. 37 for the purpose of constructing a new second synthetic turf field at Mackie Park. The City of Delta will exchange two (2) pieces of park land for one (1) piece of school land for an equal land area of 2,029 m .

The lands subject to the exchange are located at 10900 82 Avenue (Mackie Park) and 11800 86A Avenue (Hellings Park).

Alternative Approval

Council may proceed with the adoption of Delta Mackie & Hellings Park Land Exchange Bylaw No. 8382, 2024, unless at least 10% (7,573) of the eligible electors of the City of Delta sign and submit an Elector Response Form indicating their opposition to the proposed land exchange.

The proposed bylaw and related materials are available for public inspection at the Office of the City Clerk, City of Delta, 4500 Clarence Taylor Crescent, 8:30 a.m. to 4:45 p.m., Monday through Friday, excluding statutory holidays, from March 22, 2024 to April 22, 2024.

Who is eligible?

Only electors of the City of Delta are eligible to sign an Elector Response Form.

Qualified resident electors are persons meeting all of the following qualifications:

  • Is a Canadian citizen;
  • An individual who is age 18 years or older;
  • Has been a resident of British Columbia for at least six months;
  • A Delta resident or owner of property within Delta; and
  • Is not disqualified from voting by the Local Government Act or any other act.

Qualified non-resident property electors are persons meeting all of the following qualifications:

  • Is not entitled to register as a resident elector for the City of Delta;
  • Is a registered owner of real property within the City of Delta;
  • Is a Canadian citizen;
  • An individual who is age 18 years or older;
  • Has been a resident of British Columbia for at least six months; and
  • Is not disqualified from voting by the Local Government Act or any other act.

Note: Corporations and land held in a corporate name are not eligible to vote . In the case of multiple owners of a parcel, only one person may vote as a non-resident property elector.

If opposed, sign an Elector Response Form

Elector Response Forms must be in the form provided by the City and are available at the Office of the City Clerk on the second floor, City Hall, 4500 Clarence Taylor Crescent, Delta, BC, 8:30 a.m. to 4:45 p.m., Monday to Friday from March 22, 2024 to April 22, 2024. Elector Response Forms are also available on the City’s website at www.delta.ca or by calling the Office of the City Clerk at 604-946-3220 during business hours.

An originally signed Elector Response Form must be received by the City Clerk at Delta City Hall before 4:45 p.m. (PST) on April 22, 2024. Photocopies of signed forms cannot be accepted.

If you are not opposed, no action is required.
