COUNCIL CONSIDERATION OF BYLAWS – MAY 5, 2025

Notice is hereby given that Delta City Council will consider giving first, second, and third readings to the bylaws referenced below at its Regular Meeting at 5:00 p.m. on Monday, May 5, 2025 at the North Delta Centre for the Arts, Theatre,11425 84 Avenue, Delta, BC.

Location: 11944 92 Avenue Applicant: Lukas Wykpis, Keystone Architecture and Planning Ltd.

Proposal: Application for Rezoning, Development Variance Permit and Development Permit in order to subdivide the subject property into two lots and allow construction of a six-storey apartment building and eight three-storey townhouse buildings. This application is consistent with Delta’s Official Community Plan.

Delta Zoning Bylaw No. 7600, 2017, Amendment Bylaw No. 8498

To amend “Delta Zoning Bylaw No. 7600, 2017” by rezoning portions of the subject property from Comprehensive Development Zone No. 53 (C.D. 53) to:

• Apartment Residential 6 Zone (RA6) to permit a six-storey apartment building with 140 market apartment units on proposed Lot A; and

• Townhouse Residential 76 Zone (RT76) to permit 51 three-storey townhouse units on proposed Lot B.

Development Variance Permit LU009671

To vary the following provisions in “Delta Zoning Bylaw No. 7600, 2017”,

1. Section 13.50.5(a) by reducing the minimum rear setback of the apartment building on proposed Lot A from 7.5 m (25 ft) to 6 m (20 ft).

2. Section 13.24.8 by reducing the minimum lot width for subdivision of proposed Lot B from 30 m (98 ft) to 7.5 m (25 ft).

A Development Permit to address the form and character of the proposed development in the Scott Road Corridor (SRC) Development Permit Area.

Approval of the Development Permit is delegated to the General Manager, Development, as per “Development

Application Procedures Bylaw No. 8347, 2023”.

Location: 5360 12 Avenue and 1146, 1156 & 1170 53A Street Applicant: Arc Studio Architecture Ltd.

Proposal: Application for Rezoning and Development Permit in order to consolidate the subject properties and develop a six-storey mixed-use commercial and residential building. This application is consistent with Delta’s Official Community Plan.

Delta Zoning Bylaw No. 7600, 2017, Amendment Bylaw No. 8436, 2025

To amend “Delta Zoning Bylaw No. 7600, 2017” by rezoning the subject properties from Comprehensive Development Zone 286 (CD286) at 5360 12 Avenue and Single Detached Residential 1 (RS1) at 1146, 1156, and 1170 53A Street to Comprehensive Development Zone 52 (CDZ52) to permit a six-storey building with 67 market apartment units, commercial space at grade and two levels of underground parking.

Development Permit and design covenant to address the form and character of the proposed mixed-use commercial and residential building, which is located partly in the Tsawwassen Town Center (SD1-A) Development Permit Area.

Approval of the Development Permit is delegated to the General Manager, Development, as per “Development Application Procedures Bylaw No. 8347, 2023”.
